Welcome to Arachis Foods (the "Website"), operated by Arachis, having its registered office at 52, 2nd Main Road, Nanajappa Layout, Adugodi, Bengaluru – 560030, Karnataka, India (referred to as "we", "us", "our" or the "Company").

Please read these Terms of Use ("Terms") carefully before browsing the Website or placing an order. By accessing the Website or purchasing from it, you agree to be bound by these Terms, our Privacy Policy, and our Shipping, Returns and Refund Policy, all of which are available on the Website and form part of these Terms. If you do not agree, please do not use the Website.

These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it. They do not require any physical or digital signature.

1. Eligibility

1.1 You must be at least 18 years old and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to place an order on the Website.

1.2 If you are under 18, you may use the Website only under the supervision of a parent or legal guardian, who will be responsible for any order placed.

1.3 You agree to provide accurate, current and complete information when creating an account or placing an order.

2. Your Account

2.1 You may browse the Website without an account, but some features may require registration.

2.2 You are responsible for keeping your login credentials confidential and for all activity under your account. Please notify us immediately at feedback@arachisfoods.com if you suspect unauthorised use.

2.3 We may suspend or terminate accounts that provide false information, violate these Terms, or are used fraudulently.

3. Products and Descriptions

3.1 We make every effort to display product images, descriptions, weights, specifications and colours accurately. Actual products may vary slightly from images due to screen settings, lighting or natural variation.

3.2 Product availability is subject to stock. We may limit quantities, discontinue products, or refuse an order at our discretion.

3.3 Product information on the Website is for general information only and is not medical or nutritional advice. Please read the product description and packaging carefully before purchase.

4. Pricing and Payment

4.1 All prices are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Shipping charges, if any, are shown before you confirm your order.

4.2 We may change prices at any time without notice, but the price applicable to an order is the price shown at the time you place it.

4.3 If a price or description is displayed incorrectly due to a typographical or system error, we may cancel the affected order and refund any amount paid in full.

4.4 Payments are processed through third-party payment gateways and banking partners. We do not store your complete card, UPI or net-banking credentials. Your use of a payment gateway is also subject to that provider's terms.

4.5 Cash on Delivery is available on eligible orders and pin codes. We may restrict Cash on Delivery for certain locations or order values.

4.6 If a payment is debited but the order is not confirmed, the amount will be refunded to the original payment method within the timelines set by the payment provider and applicable RBI guidelines.

5. Order Acceptance and Cancellation

5.1 Placing an order is an offer to purchase. A contract is formed only when we send an order confirmation or dispatch the product.

5.2 We may decline or cancel an order for reasons including product unavailability, pricing errors, suspected fraud, inability to deliver to your address, or failure of payment verification.

5.3 You may request cancellation before the order is dispatched by chatting with us on the Website or emailing feedback@arachisfoods.com. Orders that have already shipped are subject to our Shipping, Returns and Refund Policy.

6. Shipping and Delivery

6.1 We ship to locations serviceable by our courier partners. Delivery timelines shown are estimates and not guaranteed.

6.2 Risk of loss passes to you on delivery. Please inspect the package at delivery and report any damage or tampering within 48 hours of delivery, with photographs.

6.3 We are not liable for delays caused by courier partners, weather, strikes, government restrictions, or other events beyond our reasonable control.

6.4 You are responsible for providing a complete and correct delivery address and a reachable phone number.

7. Returns, Replacements and Refunds

7.1 Our detailed policy is set out in our Shipping, Returns and Refund Policy, available on the Website.

7.2 If a product is damaged, defective, expired, incorrect or materially different from its description, please contact us within 48 hours of delivery. After verification, we will initiate a replacement or refund.

7.3 Approved refunds are processed within 5–7 business days to the original payment method (or by bank transfer or UPI for Cash on Delivery orders).

7.4 Nothing in this section limits your rights under the Consumer Protection Act, 2019 or any other applicable law.

8. User Conduct

You agree not to:

- use the Website for any unlawful, fraudulent or harmful purpose;
- place orders with false information or use another person's payment instrument without authority;
- interfere with the Website's security, servers or functionality, including by introducing viruses, scraping data, or using bots or automated tools without our written consent;
- attempt to gain unauthorised access to any account, system or network;
- post reviews or content that is false, defamatory, obscene, abusive, infringing, or otherwise unlawful under any law in force in India;
- resell products purchased from the Website for commercial purposes without our written permission.

9. Reviews and User Content

9.1 If you submit reviews, ratings, photographs or other content ("User Content"), you confirm that you own it or have the right to submit it, and that it does not violate any law or third-party rights.

9.2 You grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, display and distribute your User Content in connection with the Website and our marketing.

9.3 We may remove User Content that violates these Terms or applicable law. Reviews are moderated in line with the Consumer Protection (E-Commerce) Rules, 2020, and we do not favour positive or negative feedback.

10. Intellectual Property

10.1 All content on the Website, including text, logos, brand names, images, product photography, graphics, layouts, packaging designs and software, is owned by or licensed to us and protected under the Copyright Act, 1957, the Trade Marks Act, 1999 and other applicable laws.

10.2 You may view and print content for personal, non-commercial use only. You may not copy, modify, distribute, sell or exploit any content without our prior written permission.

16. Force Majeure

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including natural disasters, epidemics, government orders, strikes, transport disruption, power or network failure, or acts of war or terrorism.

17. Termination

We may suspend or terminate your access to the Website at any time, without notice, if you breach these Terms or if required by law. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnity and governing law) will continue to apply.

19. Governing Law and Dispute Resolution

19.1 These Terms are governed by the laws of India.

19.2 Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably by contacting our Grievance Officer.

19.3 If a dispute is not resolved within 30 days, it shall be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka, India, without prejudice to your right as a consumer to approach the appropriate Consumer Commission under the Consumer Protection Act, 2019, or to use the National Consumer Helpline.

20. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on the Website with a revised "Last updated" date. Continued use of the Website after changes are posted means you accept them. Orders are governed by the Terms in force at the time they are placed.

21. General

- Entire agreement: These Terms, together with our Privacy Policy and Shipping, Returns and Refund Policy, form the entire agreement between you and us regarding the Website.
- Severability: If any provision is held invalid or unenforceable, the remaining provisions continue in full force.
- No waiver: Our failure to enforce any right or provision is not a waiver of it.
- Assignment: You may not assign your rights under these Terms without our consent. We may assign ours to an affiliate or successor.
